McKenna, Reed, Federal Judge throw 138,000 citizen defenders of marriage under bus PDF Print E-mail

When dialogue and disagreement degenerate into the thuggery of intimidation and retaliation, civility is lost, and with it our liberties.

October 17, 2011 - Sadly, and in spite of the hundreds of pages of documented examples of threats and reprisals directed at supporters of traditional marriage, not only in Washington but across the country, Federal Court Judge Benjamin Settle ruled on Monday that the 137,500 names on the Referendum 71 petition are now public information.

Secretary of State Reed and Attorney General McKenna have argued, at great expense to Washington State taxpayers, that the names of the signers should be made public in the name of disclosure. Reed hailed Settle's decision as "a victory for transparency and open disclosure in our state's referendum and initiative process" and said he would release the names immediately.


Protect Marriage Washington's legal team, led by Attorney James Bopp Jr., has filed a notice of appeal of the decision and an emergency motion for an injunction that will be filed in the 9th Circuit Court of Appeals.


Protect Marriage Washington sued the state over 26 months ago to block release of the Referendum 71 petitions when two militant homosexual activist groups vowed to reveal the names of signers on a pair of searchable websites, whosigned.org and knowthyneighbor.org; and to encourage  their readers to initiate "uncomfortable conversations" with signers.

Evidence brought forward by Protect Marriage Washington included death threats, extensive vandalism, overt threats of destruction of property, arson and threats of arson, intimidating emails and phone calls, hate mail, mailed envelopes containing white suspicious powder, blacklists, loss of employment and job opportunities, and gross expressions of anti-religious bigotry, including vandalism and threats directed at religious institutions and religious adherents-all for doing nothing more than standing up for traditional marriage. Nevertheless, Judge Settle wrote that Protect Marriage Washington was unable to prove "a reasonable probability that the threats, harassment, or reprisals exists as to the signers of R-71, now nearly two years after R-71 was submitted to the voters in Washington State."

As noted by the Seattle Times on Monday, "in making its case for secrecy, Protect Marriage faced a Catch 22: that it was impossible to show harassment of people whose names were not public."

Protect Marriage Washington Attorney Stephen Pidgeon called Judge Settle's decision a "dramatic setback to the right of privacy in the state of Washington. There were death threats, acts of violence, harassment and published declarations that there would be harassment. The court erred."


Larry Stickney, Campaign Manager for Protect Marriage Washington said he was "disappointed by the decision but not surprised. After all, we live in the politically correct State of Washington," said Stickney. "What did surprise me throughout the process, however, was the complete lack of empathy and seeming hostility we encountered from the Attorney General's office. Rob McKenna's personal efforts to trivialize the confrontations, the threats, the obscenity laced e-mails and phone calls that we endured may have won him the case, but it will not win him the hearts of 138,000 citizen defenders of marriage in Washington State."


"We have argued that our cause was an unusual circumstance which put pro-marriage citizens who participated in the R-71 initiative process in danger of unwanted threatening calls, contacts or worse, and should be handled with discretion and consideration", said Gary Randall, President of the Faith and Freedom Network. "We have argued that releasing the signatures would create a chilling effect on all future initiative efforts regarding homosexual efforts to redefine the culture. The decision to release the names is bad news for Washington State.  I believe there will be more harassment, and I pray to God there isn't more than that".

Here is the latest on our upcoming trial (rescheduled for October 3) as reported today by Gary Randall, President of Faith and Freedom Network:

The Judge has just canceled the upcoming R-71 trial.

The case, Doe v. Reed, is to decide if the names of those 138,000 who signed R-71 petitions should be turned over to several homosexual activist groups so they may "contact" those who signed the petitions in support of natural marriage.

Instead of the scheduled 5-day trial, the judge decided this morning to hear oral arguments from both sides and make his decision based on the briefing, deposition testimony and exhibits.

A summary judgement.

As you know. Secretary of State Reed and Attorney General McKenna have argued, at great expense to the state, that the names should be released to the homosexual activists in the name of disclosure.

We have argued that this is an unusual circumstance which puts pro-marriage citizens who participated in the initiative process in danger of unwanted threatening calls,contacts or worse, and should be handled with discretion and consideration.

If Reed and McKenna prevail, it will create a chilling affect on all future initiative efforts regarding homosexual efforts to redefine the culture.

Washington State Attorney General, Rob McKenna, won a national award for his work in forcing the release of names who signed the R-71 petitions to the homosexual activist groups who are demanding them---who have said publicly they want to have a "conversation" with those who signed.

Although names were sealed to the public in the past in relation to "Hands Off Washington," a homosexual activist organization that feared gay activist members would be harassed, Secretary of State Sam Reed and Attorney General Rob McKenna have worked tirelessly at great public expense to release the names of those pro-marriage citizens who signed the R-71 petitions.


As you know, we have objected, the case has been heard several times and is still pending. The names remain sealed at this time with another trial scheduled later this month.


The national award was given by the National Lawyers Association for "
Best Brief " this past year. We only recently became aware of the award.

McKenna said he was proud of his team and "Hart, Collins and Egeler are truly the state's dream team of appellate attorneys."


Larry Stickney, myself and others who have been deposed by the "team" on subjects varying from theological beliefs and personal beliefs about Islam, to the use of benign words on our web site, etc. and a wide range of subjects unrelated, in our opinion, to the R-71 case, have a very different view of the matter. The word "dream" does not come to mind.


On behalf of the 138,000 citizens who signed the R-71 petitions, exercising their right to participate in the election process not knowing they would be "contacted" by homosexual activists for a "conversation," we congratulate the Attorney General for his outstanding work in creating a chill on the initiative process. Particularly within the faith community regarding marriage.

KOSTER BLASTS FEDS FOR PROSECUTION OF LYNDEN FARMER; CITES INCOHERENT LARSEN/OBAMA IMMIGRATION POLICIES AS CAUSE

LYNDEN, WA - July 19, 2011- In a message written by John Koster to Whatcom County Republicans and delivered in a speech in Lynden by a campaign representative on Saturday, Koster blasted the Federal prosecution of Lynden farmer Wayne Groen and the incoherent border policies of President Obama and Congressman Rick Larsen.

"This is the heavy hand of the Federal Government at its worst," said Koster. "Here we have a relatively minor incident where a law abiding citizen of the United States shines a flashlight into the eyes of a helicopter pilot hovering over his private property some 500 feet above. A brash and imprudent thing to do? Yes, but not the stuff of a federal prosecution."

Groen's Lawyer, Jeffrey Lustick, told a crowd of several hundred concerned citizens who gathered at a June 21st community meeting in Lynden that he was shocked when he heard the U.S. attorney handling the case wanted prison time for Groen (he was originally to be charged with a misdemeanor), and that "most of all they wanted to make an example out of Wayne Groen and send a message to all of you...that this type of behavior would not be tolerated."

Jenny Durkan , is an Obama appointee who served as a confidante to Democratic Governors Mike Lowry and Chris Gregoire.

The Groen situation was first brought to John Koster's attention by concerned citizens having difficulties getting the attention of their federal officials on this matter. Mr. Koster has since spoken to Mr. Groen's wife, his attorney, friends, neighbors and other concerned citizens.


"I have been told that Congressman Larsen's office has been contacted repeatedly about the case yet there has been no response," said Koster. "Nor was Larsen or any staff present at the community meeting in Lynden June 21 that was held in support of Mr. Groen."


Koster has been highly critical of
Larsen's record on illegal immigration in the past. His comments on Saturday spelled out his extreme displeasure and disbelief that current border policies are so conflicted "that we are now prosecuting the people that we are supposed to be protecting. Congressman Larsen repeatedly votes the pro-amnesty side on illegal immigration, yet ignores the grave predicament of one of his own constituents."

President Obama and Congressman Larsen have consistently failed to protect our borders and its citizens. Instead, private citizen, family man, and Lynden farmer, Wayne Groen, is facing a statutory maximum of 20 years in prison.


U.S. Attorney's Office spokeswoman, Emily Langlie, said that Groen would likely get something far below the 20 year maximum. Nevertheless, he is
scheduled for sentencing by U.S. District Judge Thomas S. Zilly on Aug. 4.

On June 27, Koster wrote a letter to Washington State Congressional Representatives Doc Hastings and Cathy McMorris Rodgers explaining the situation. He also discussed the matter via telephone with McMorris Rodgers last week and plans to continue bringing attention to the Groen family's plight as well as to certain unresolved relational issues between the property owners and the U.S. Border Patrol.


"After attending the June 21 meeting, it is obvious to me that the situation along the northern border has become increasingly tense between the private property owners and the USBP", said Koster.


While the property owners appreciate the efforts and zeal of the USBP to defend the northern borders from the threats posed by terrorists, drug runners, and illegal aliens, the prosecution of Wayne Groen for a relatively minor mistake committed on his own property appears to be heavy-handed and overreaching at the very least. There is a strong need for better communication between property owners and those we hire to defend U.S. citizens and our borders.


John Koster is urging citizens to lodge complaints about the prosecution of Wayne Groen via e-mail or telephone as soon as possible to the offices of Congressman
Rick Larsen , Senator Patty Murray and Senator Maria Cantwell .
